Mediation & Arbitration

I am an Accredited Mediator under the Australian National Mediator Accreditation System. I trained with The Accord Group, and obtained a Certificate of Commercial Mediation.

I regularly act as a mediator in relation to a diverse range of commercial disputes within my areas of practice as set out above, and in relation to estate disputes, particularly Testator Family Maintenance claims.

After many years of experience I have developed the skills necessary to be effective in my role as mediator. I believe that I have excellent communication and interpersonal skills, and I welcome the opportunity to assist the parties in identifying the main issues in dispute, facilitating communication and mutual understanding of the parties’ perspectives, identifying the underlying needs and interests of the parties, fostering realistic expectations by effective reality testing in private discussions, and exploring options for a possible resolution of the dispute.

I see my role as a facilitator whose objective is to assist the parties to reach a mutually acceptable resolution of the dispute. In my role as mediator I am firmly committed to, and indeed I am duty-bound to, protect the absolute confidentiality of all matters conveyed to me by a party in private discussions with me.

Where required, I am happy to assist the parties to record their agreement to resolve the dispute in writing.

In my experience, the majority of cases are able to be successfully resolved at mediation.

Apart from cases where I act as the mediator, I am regularly briefed to represent parties at mediation in cases where I have the conduct of the proceeding as counsel on behalf of one of the parties.

I have appeared as counsel, or have acted as arbitrator, in many commercial arbitration proceedings. I am familiar with the procedures and practices applicable to arbitrations.
